Kaplan would be following in the footsteps of former Special Counsel and now 9th Circuit Judge Alex Kozinski, who started his judicial career on the Court of Claims. Kaplan is currently the general counsel of the Office of Personnel Management. Previously she served as the general counsel of the National Treasury Employees Union.

The conduct outlined in my victim impact statement to Judge Wilkins in the Scott Bloch matter was also reported, contemporaneously, to former Special Counsel Elaine Kaplan. That same conduct and more, as outlined in my 30-page affidavit has been verified by all appropriate oversight authorities. The details are worse. So much for the “rule of law.”

At least she wasn’t nominated to the Federal Circuit, has had been rumored. Her subject matter will be contracts with the U.S. government, and not whistleblower/MSPB matters, thankfully.
As a recap, Kaplan was a former union official in 1994 when she got Congress to weaken whistleblower laws to benefit her union, then she became Special Counsel under the Clinton Administration where she ignored a number of allegations and really was not all that special. That did not stop GAP, POGO and others from giving her an award at the end of her tenure. Then she went to an employment law firm (presumably benefitting from a broken system that she could have–but did not–fix), then to become general counsel of the same union and then general counsel of OPM.
It’ll be interesting to see the sell-out NGOs above fall all over themselves to congratulate a fellow insider and exploiter of whistleblowers.
It’s a sick, sick system we’ve got here.
